The makers of Kala Hiran: The Battle for Legacy, a film reportedly inspired by the 1998 blackbuck poaching case involving Salman Khan, have announced that they will approach the Supreme Court after the Delhi High Court ordered the removal of the film’s teaser and related promotional content.
The High Court issued the directions while hearing a petition filed by Salman Khan, who alleged that the film’s promotional material violated his personality rights. The court directed that the teaser be taken down from online platforms and also ordered the removal of interviews featuring the film’s producer, Amit Jani.
Delhi High Court Raises Concerns Over Reputation
During the proceedings, the court made strong oral observations about the need to protect an individual’s reputation. It expressed concern over what appeared to be clear references to Salman Khan in the film’s promotional material and indicated that a detailed order containing stronger observations would follow.
According to Salman Khan’s legal petition, the teaser and posters make identifiable references to him without authorization. The actor claimed that one of the characters resembles him by wearing his iconic blue bracelet, while another promotional poster features a rifle, which could create a misleading impression among viewers.
His plea further argued that such portrayals are particularly problematic because he was acquitted in the Arms Act case connected to the 1998 blackbuck hunting matter.
Filmmakers Cite Freedom of Creative Expression
Responding to the High Court’s decision, director Bharat S. Shrinate said the production team fully respects the judiciary but believes the issue also involves the constitutional right to freedom of expression and artistic creativity.
He stated that while every individual has the legal right to protect their reputation and personality, filmmakers also enjoy constitutional protections that allow them to tell stories through cinema.
Shrinate said the team believes the balance between personality rights and creative freedom should be determined through the legal process. As a result, they have decided to challenge the High Court’s order before the Supreme Court and seek appropriate legal relief.
He also expressed confidence in the judicial system, saying the filmmakers trust that the matter will be decided in accordance with the Constitution and the law.
Film to Be Submitted for CBFC Certification
The director confirmed that Kala Hiran: The Battle for Legacy will soon be submitted to the Central Board of Film Certification (CBFC) for review.
With the matter now expected to reach the Supreme Court, the legal dispute is likely to focus on the balance between an individual’s personality rights and the constitutional protection granted to artistic and creative expression.
For now, the Delhi High Court’s directions remain in effect, requiring the removal of the film’s teaser and related promotional material until further legal proceedings take place.
